The EU has adopted a law in respect of illegal online content and services, called the Digital Services Act (DSA). The regulation applies to online intermediaries (such as marketplaces, social media platforms, hosts, caching services) that offer their services to EU-based users, regardless of where the service itself is headquartered. Like the EU GDPR, the law’s many obligations may require companies to consider this issue during product development and to adopt or modify their policies and processes. Sanctions for non-compliance will be significant (up to 6% of global annual revenue).
