Employment partner Renee Phillips will be speaking on a panel titled, “Whistleblower Update: Emerging Issues and Best Practices for Bringing and Defending Against Whistleblower Claims” at ABA’s 2017 National Conference on Equal Employment Opportunity Law.

Join in-house and defense lawyers on this advanced program on critical legal developments in whistleblower claims. Whistleblower claims can arise from a complex set of statutes including the False Claims Act, SOX, Dodd-Frank, state law claims, and over 20 federal statutes enforced by the U.S. Department of Labor that cover a variety of industries. This advanced panel will provide an update on critical legal developments in the law of whistleblowing, including the SEC and CFTC reward (“bounty”) programs, under which even individuals with compliance-related jobs are able to obtain an award under certain circumstances; recent DOL Administrative Review Board decisions under SOX and Dodd- Frank; and the intersection of EEO law and whistleblower claims.

Experienced practitioners also will discuss the relevant provisions of the recently enacted Defend Trade Secrets Act of 2016 which provides limited whistleblower immunity from certain trade secret misappropriation. This panel will explore these critical new developments and their significant implications for either prosecuting or defending against whistleblower claims and associated government investigations.
