A Federal Circuit decision on statutory patent term guarantees for Patent Office delays has caused upheaval for innovators and created uncertainty the U.S. Supreme Court should resolve, according to Orrick’s Irena Royzman and Lauren Drake.

In a new article for Bloomberg Law, they urge the U.S. Supreme Court to take up and reverse the Federal Circuit’s decision in In re Cellect.

“This development in the law impacts nearly half of U.S. patents across industries,” they write. “It is likely to cost American biopharma and tech innovators billions in lost patent term.”
