The Daily Journal has selected Patriot Rail Corp. v. Sierra Railroad Company as one of its Top Defense Results of 2014. This annual list recognizes the litigation victories that had a major impact on individuals, industries and the larger society, as well as honors the litigators that demonstrated exceptional trial skills.
In Patriot v. Sierra, Orrick's Greg Scott, Michael Weed and J.R. Riddell successfully secured a $52.8 million judgment for Sierra Railroad in a trade secrets case they were brought in to litigate only six months before trial. In this truly bet-the-company litigation everything was at stake for Sierra including nearly six years of litigation and lost revenues that had driven Sierra to near financial ruin. The Orrick team not only defeated all of Patriot’s claims against Sierra but delivered to Sierra a judgment of nearly $53 million to help ensure their client’s survival.
The Patriot v. Sierra litigation was also recognized by Law360 as one of the nation’s largest IP awards of 2014 and the largest trade secrets award on their Top IP Awards of 2014 list.
