Orrick and Morgan Lewis represented global nuclear services company EnergySolutions in the decommissioning of the La Crosse Boiling Water Reactor (LACBWR) site located in Genoa, Wisconsin, owned by Dairyland Power Cooperative.
LACBWR was originally built as a joint project with the federal Atomic Energy Corporation, and operated from 1967 to 1987. The closing of the transaction follows the Nuclear Regulatory Commission’s approval in late May of the transfer of the license for the facility from Dairyland Power Cooperative to LaCrosseSolutions, a subsidiary of EnergySolutions. Under the terms of the decommissioning agreement, LaCrosseSolutions will dismantle LACBWR and remove its existing buildings and structures from the LACBWR site.
The Houston-based Orrick team advising on the transaction was led by Energy & Infrastructure partner Jonathan Ayre and included assistance by Energy & Infrastructure partner Darrell Thomas who advised on real estate matters. The Morgan Lewis team was led by Energy partner John Matthews (Washington, DC) and included Houston partner Chris Amandes addressing environmental matters and Philadelphia partner Paul Gordon on tax matters.
