Our team, led by Chief Innovation Officer Wendy Curtis, played a key role in an amicus brief filed on behalf of Lawyers for Civil Justice (LCJ) in an important legal test for standards in litigation discovery disputes. For this work, LCJ – an organization focused on promoting fairness in the justice system by fighting soaring litigation costs – recognized Wendy as an “Outstanding Contributor” at their annual awards ceremony on December 6th.
LCJ filed the brief in support of a leading tech company (U.S.), after a magistrate judge in California granted $300,000 in sanctions against the leading tech company (U.S.) for delays in handing over documents in connection with an antitrust suit brought by the Federal Trade Commission against Qualcomm. The amicus brief urged a California federal judge to lift the unusual sanctions order. On behalf of our client, our team argued that the sanctions finding against the leading tech company (U.S.) was unduly harsh and would establish extraordinary precedent for document production-related sanctions under civil litigation rules. Before even hearing arguments on the matter, the Northern District of California, referring to our team’s brief, lifted the sanctions order.
