Orrick partner Mel Bostwick joined Bloomberg Law’s Kimberly Robinson and Jordan Rubin on their Cases and Controversies podcast to discuss Andy Warhol Foundation v. Goldsmith, a copyright case before the Supreme Court which centers around whether Warhol prints of a Prince photo transformed the original work’s message.
Mel, who filed an amicus brief in the case on behalf of the Institute for Intellectual Property and Social Justice along with several scholars, says this is an opportunity for SCOTUS to “put some more meat on the bones” of the test courts should use when determining whether permission is needed in copyright cases.
