J.P. Schreiber is an experienced employment litigator and advisor with a track record of successful outcomes in employers’ most complex and high-stakes legal challenges.

J.P.’s strategic mindset draws from his experience across all phases of litigation in state and federal courts, arbitration, and before government agencies. His experience spans a breadth of issues including those related to wage-and-hour laws, the California Private Attorneys General Act (PAGA), trade secret theft, restrictive covenants, contract disputes, pay equity, discrimination, harassment, retaliation, disability accommodation, leaves of absence, and wrongful termination.

Additionally, J.P. regularly counsels employers on best practices to meet their business goals in a way that minimizes legal risk. He partners with clients to address employment issues such as wage-and-hour compliance, high-risk personnel decisions, mass workforce changes, the development of compliant policies, the drafting of complex employment agreements, and recent changes in employment laws.

    J.P. joined Orrick from another global law firm, where he litigated and counseled on behalf of major employers in high-stakes matters.

  • Trial and Arbitration Victories

    • Earned complete defense award for client as second chair in high-stakes restrictive covenant arbitration asserting over $16 million in damages, then obtained an award for client of nearly $1 million in attorneys’ fees and costs.
    • Defended client at California Labor Commissioner hearing and obtained a decision awarding the plaintiff only 7% of her claim for lost wages. Then, when the plaintiff appealed the decision to the Superior Court, first-chaired a de novo trial of the claims and won a complete dismissal of the appeal.
    • Obtained complete defense award for client in high-stakes arbitration hearing involving allegations of pervasive racial harassment.

    Class and PAGA Victories

    • Prevailed for client on class certification opposition in exempt misclassification class action.
    • Prevailed for client on Fed. R. Civ. P. 12(b)(6) motion to dismiss in high-stakes wage-and-hour class action that resulted in dismissal of both individual and class claims.
    • Achieved numerous victories for clients on motions to compel arbitration of PAGA claims involving developing case law under Viking River Cruises v. Moriana, including one victory in a complex, high-stakes class/PAGA action that received media coverage.
    • Proactively ran several high-stakes class and Private Attorneys General Act (“PAGA”) actions often involving eight- or nine-figures in estimated exposure, leading each to mediated settlements at which the client paid only a fraction of the estimated exposure.

    Other Litigation Victories

    • Prevailed for client on motion for summary judgment in single-plaintiff action involving claims for disability discrimination and harassment.
    • Prevailed for client on Fed. R. Civ. P. 12(b)(2) motion to dismiss based on lack of personal jurisdiction, resulting in the plaintiff voluntarily dismissing and abandoning the entire action instead of opposing the motion.
    • Prevailed for client on motion to compel arbitration based on arbitration agreement that had not been previously enforced, and which carried substantial precedential weight due to several later-filed actions involving the same agreement.
    • Brought in and prevailed for client on motion to compel arbitration based on an agreement that the same court had declined to enforce in the client’s most recent motion to compel.
