The article sets out the genesis of the AI Act and important aspects of the initial AI Act drafts. Further, it focuses on setting out the AI Act's structure and particularities as well as its extraterritorial scope. The article also outlines measures taken to prevent the AI Act's provisions from stifling innovation in the EU and the functioning of the AI Act's inherent risk based approach. Under this approach, whether and to what extent the AI Act's requirements apply depends upon the risk level of an AI system or AI model.
