In the current edition of the German law journal Betriebs-Berater (31/2024), Daniel Ashkar discusses current developments in the public enforcement of the GDPR in the European Union and Germany.

The article outlines important aspects and consequences of the landmark judgment from the Court of Justice of the European Union (CJEU) on the requirements for the levying of GDPR fines and the subsequent decision from Berlin’s Court of Appeal in the relevant fine proceedings on which the CJEU judgement was based.

Additionally, the article covers legislative reform efforts of the European Union regarding the cross-border, public enforcement of the GDPR.

In light of these developments, the article sets out the importance of an effective data privacy compliance system to prevent GDPR fines. Hereby, aspects are set out on which companies should generally put a particular focus in this regard.
